The state has revoked a Delaware County nursing-care facility’s license following the arrest this month of three workers on allegations that they abused a patient.

A Department of Public Welfare report, released Friday, found “gross incompetence, negligence, and misconduct on the part of officials” at Quadrangle Sunrise Senior Living Center in Haverford as well as its parent company, Sunrise Senior Living of McLean, Va.

In a statement Friday evening, company administrators said they had filed an appeal, and expressed hope that they “can quickly resolve this unfortunate matter.”

The investigation into abuses at the center will continue, said Michael Race, a DPW spokesman. “It remains to be seen if this instance was an aberration,” he added.

Calls to Quadrangle, a 143-bed facility at 3300 Darby Rd., were not returned.

The three “care managers” were charged with taunting and physically abusing Lois McCallister, a 78-year-old dementia patient, for 12 minutes and blocking her door when she tried to escape.  read more

Bank Failures #35 through #39 in 2011 – First National Bank of Central Florida, Winter Park and Cortez Community Bank, Brooksville

Premier American Bank, National Association, Miami, Florida, acquired the banking operations, including all the deposits, of two Florida-based banks. To protect depositors, the Federal Deposit Insurance Corporation (FDIC) entered into purchase and assumption agreements with Premier American Bank, N.A.

First National Bank of Central Florida, Winter Park, Florida, was closed today by the Office of the Comptroller of the Currency, which appointed the FDIC as receiver. Cortez Community Bank, Brooksville, Florida, was closed by the Florida Office of Financial Regulation, which appointed the FDIC as receiver.

All eight branches of the two closed banks will reopen on Monday as branches of Florida Community Bank, a division of Premier American Bank, N.A. Depositors of the two failed banks will automatically become depositors of Florida Community Bank. Deposits will continue to be insured by the FDIC, so there is no need for customers to change their banking relationship in order to retain their deposit insurance coverage up to applicable limits. First National Bank of Central Florida had six branches; and Cortez Community Bank had two branches.

Customers of the two failed banks should continue to use their former branches until they receive notice from Premier American Bank, N.A. that it has completed systems changes to allow other branches of Premier American Bank, N.A. to process their accounts as well. Over the weekend, depositors can access their money by writing checks or using ATM or debit cards. Checks drawn on the bank will continue to be processed. Loan customers should continue to make their payments as usual.

A lawsuit against a local nursing home has been moved from Cook County where it was filed in July 2010 to Madison County.

It accuses Virgil Calvert Nursing & Rehabilitation Center Inc. of abusing a resident and ultimately causing his death.

Judith Boyd, on behalf of her deceased husband, Larry Boyd, also names Virgil Calvert Property LLC, Cahokia Nursing & Rehabilitation Center Inc., SW Management Company and Cahokia Building LLC as defendants. Twenty-six other defendants are also listed.  read more

A West Virginia woman has filed a lawsuit against HCR Manorcare for nursing home neglect, alleging that one of the nursing home chain’s facilities let a relative’s health deteriorate due to poor care.

The nursing home wrongful death lawsuit was filed by Angela Black on March 28 in Kanawha Circuit Court in West Virginia. The complaint names HCR Manor Care Services and a number of other defendants.

According to the lawsuit, Black’s relative, Arcel Rose, died in March 2009 after his health deteriorated while being cared for by Manorcare. As a result of neglect, the family alleges that Rose suffered from nursing home dehydration and malnutrition, untreated bedsores and nursing home infections. The problems caused Rose to suffer mental and physical trauma and, eventually, death.  read more

A yearlong sting operation, including aliases, a 5 a.m. surprise inspection and surreptitious purchases from an Amish farm in Pennsylvania, culminated in the federal government announcing this week that it has gone to court to stop Rainbow Acres Farm from selling its contraband to willing customers in the Washington area.

The product in question: unpasteurized milk.

It’s a battle that’s been going on behind the scenes for years, with natural foods advocates arguing that raw milk, as it’s also known, is healthier than the pasteurized product, while the Food and Drug Administration says raw milk can carry harmful bacteria such as salmonella, E. coli and listeria.

“It is the FDA’s position that raw milk should never be consumed,” said Tamara N. Ward, spokeswoman for the FDA, whose investigators have been looking into Rainbow Acres for months, and who finally last week filed a 10-page complaint in federal court in Pennsylvania seeking an order to stop the farm from shipping across state lines any more raw milk or dairy products made from it.  read more
